President Biden Revokes “Buy American, Hire American” Executive Order

President Biden has issued an Executive Order titled “Ensuring the Future is Made in All of America by All of America’s Workers” requiring government agencies to purchase goods, products, materials and services from U.S. companies as a way to “help American businesses compete in strategic industries and help America’s workers thrive.”
The order is not geared toward curtailing immigration and revokes the “Buy American Hire American (BAHA)” Executive Order issued by President Trump in April 2017. BAHA specifically led to deleterious government actions such as an increase in requests for evidence (RFEs), the USCIS “no deference to prior approvals” policy, extreme vetting of visa applications at consular posts, in-person interviews for all employment-based adjustment of status applications, the Public Charge Rule and Form I-944, and most recently the new DOL wage rule which raises prevailing wages for all H-1B and E-3 employees and PERM applications.
