USCIS To Implement New Public Charge Rule and Forms on February 24, 2020

On January 27, 2020, the Supreme Court issued a decision allowing implementation of the Trump administration’s new public charge rule, even as challenges to the rule remain to be heard by lower courts. The new public charge rule has been widely criticized for its expansion of the definition of public charge.  

USCIS will implement the Inadmissibility on Public Charge Grounds final rule on February 24, 2020  (except in Illinois where the rule remains enjoined). The new rule will apply to applications and petitions filed or submitted electronically on or after that date. Applications filed on or after February 24, 2020 must also be completed using new forms, a complete list of which is available through the USCIS news release titled “Public Charge Inadmissibility Final Rule: Revised Forms and Updated Policy Manual Guidance.”
