USCIS Announces It Will Use the Dates for Filing Chart for October 2020

As discussed in our previous post, USCIS has now announced that it will use the Dates for Filing chart from the October Visa Bulletin.  

Weaver Schlenger will contact our corporate clients’ HR representatives to seek authorization to file an Adjustment of Status case where an employee’s priority date is now current under the Dates for Filing for Employment-Based Preference Cases. 

We recognize there is potentially significant forward movement under the Dates for Filing particularly for India. We note that the EB-3 category has actually advanced further than the EB-2 category for India. In some cases, an applicant may concurrently file an AOS application if we downgrade the I-140 petition from EB-2 to EB-3. However, this would require a separate I-140 amendment filing. We will discuss these options with HR where relevant.
