Employees May Present Form I-797 EAD Approval Notice as Evidence of Employment Authorization in Light of Delays in EAD Production

August 19, 2020 

The USCIS has announced that employees may provide Form I-797, dated December 1, 2019 through August 20, 2020, notifying applicants of approval of the Application for Employment Authorization (EAD) as evidence of employment authorization for Form I-9.  The Form I-797 Approval Notice should be accepted as a List C document until December 1, 2020.  

The Form I-797 should not be accepted as a List A or List B document.  

This USCIS has provided this temporary measure following widely-reported EAD card production delays.
