Fiscal Year 2019 H-1B Cap Has Been Reached

Today, the USCIS announced that it has reached the congressionally-mandated 65,000 H-1B visa cap for fiscal year 2019. USCIS also received a sufficient number of H-1B petitions to meet the 20,000 visa U.S. master’s degree category. 

USCIS will continue to accept and process petitions that are otherwise exempt from the cap, such as H-1B extensions, requests for change of employer, and amendments.

Now, the USCIS will hold the random lottery to select 85,000 cap-subject petitions from the petitions it has received during the first five days of April.  Petitions not selected in the lottery will be returned to the employer or employer’s representative over the coming weeks and months.  Petitions which are selected in the lottery will receive a receipt notice.
