USCIS Resumes H-1B Premium Processing For Academic and Non-Profit Research Institutions

The USCIS announced today that it will resume the option of premium processing for H-1Bs filed by cap-exempt academic and non-profit research institutions. As we reported previously, the USCIS had suspended premium processing for all H-1B petitions as of April 3, 2017.
Today’s announcement does not include H-1B petitions filed by for-profit employers. Therefore, requests by these employers for fiscal year H-1Bs, H-1B extensions of status or H-1B change of employer are still not eligible for premium processing at this time.
Weaver Schlenger LLP has prepared FAQs for H-1B transfers starting employment upon government receipt of the H-1B petition. Starting upon H-1B receipt is permitted by the USCIS, and means that the employee and new employer do not need to wait several months while the USCIS processes the H-1B transfer request.
