U.S. Appeals Court Upholds District Court TRO on Immigration Ban

Today, the U.S. Court of Appeals for the Ninth Circuit issued a unanimous opinion upholding the District Court’s temporary restraining order which prohibits the federal government from enforcing the immigration bans set out in the January 27, 2017 Executive Order on Immigration. The Trump Administration is likely to appeal this decision to the U.S. Supreme Court.
This means that for now, the following provisions of the Executive Order shall not be enforced:
- the 90-day travel ban on immigrants and nonimmigrants from designated countries (Iran, Iraq, Libya, Somalia, Sudan, Syria, and Yemen);
- the 120-day ban on the U.S. refugee program;
- the prioritization of certain refugee claims based on being a religious minority; and
- the indefinite suspension of Syrian refugee admissions.
