Trump Administration Wishes to Renegotiate NAFTA; Impact on NAFTA Nonimmigrant Visas is Unclear

The White House reports that yesterday, President Trump spoke with Mexican President Nieto and Canadian Prime Minister Trudeau and advised them of the U.S.’ intention to renegotiate the North America Free Trade Agreement (NAFTA). This was in contrast to earlier reports that the Trump Administration intended to withdraw from NAFTA entirely.
The timing of renegotiations is unclear, as is the impact on the immigration portions of NAFTA.
It is possible that the following visa categories under NAFTA will be ultimately affected, though to what extent is unclear:
- TNs for Mexicans and Canadians;
- NAFTA L-1s for Mexicans and Canadians
- B-1 Business Visitors under NAFTA
At this time, employers may wish to identify employees who hold NAFTA-based visa status to consider strategies in the event that renegotiations alter, limit or eliminate the visa categories.
