DOS’ Revised October Visa Bulletin Will Supersede the earlier Bulletin released September 9, and Strikes a Blow to many Indian and Chinese National Employees

This afternoon, the Department of State published a Revised Visa Bulletin, which DOS related will supersede the earlier Visa Bulletin published on September 9, 2015. In a move that will be remembered as not the USCIS or the Department of State’s finest hour, the Revised Visa Bulletin rolls back priority dates for Dates of Filing by as much as two years. The USCIS earlier this month had touted its efforts with the Department of State in creating the new category allowing certain foreign national employees the ability to file for adjustment of status years before they would be granted green cards. After canceling a scheduled teleconference for its stakeholders last week, the USCIS has continued its radio silence offering no guidance on the process for filing these types of cases.
