Modest Gains for EB-3 India and EB-2 Chinese Nationals While we wait for Obama’s Immigration Executive Actions to come to Fruition

The Department of State’s January Visa Bulletin, released today, shows numbers will hold steady for EB-2 India while advancing slightly for EB-3 India and EB-2 China. EB-3 China moved forward 9 months. Following President Obama’s announcement of initiatives two weeks ago, it seems likely that we can expect significant forward movement once agencies take requested actions. In particular, the Department of Homeland Security has directed that government agencies make sure all visa numbers are used each year, and more importantly, to analyze and possibly determine that a primary green card applicant's family members not be counted towards the limited 140,000 annual quota for employment-based green cards. This could help diminish excessively long waiting periods but at present we do not know how long until the changes will be implemented, or if at all.
